HTC’s troubles just worsened, as Nokia has won another injunction against the company, this time in Germany. After winning injunctions against HTC in the US, UK and Netherlands, Nokia won the patent injunction against all of HTC devices being sold in the country.
The patent is question is EP1148681, which relates to peer-to-peer sharing over Bluetooth and NFC. The patent is non standard-essential, thus Nokia isn’t bound under the FRAND obligations. This win allows Nokia to ban the sales of all of HTC devices being sold in the country. Meanwhile, HTC is expected t appeal against the ruling. Google also isn’t sitting idle, and has applied for a nullity complaint challenging the patent. Although that won’t save HTC in time for the ban.
